Any additional fees must be disclosed before the customer commits to payment.

Prices, plan features and promotional arrangements may be updated for future purchases.

Changes affecting existing subscriptions will be handled in accordance with the applicable contract, mandatory notice requirements and relevant law.

5. Subscription Billing

Where a customer purchases a recurring subscription, billing will follow the payment frequency, amount and payment method disclosed during the purchase process.

At the time of publication, PayPal subscription activation on the website is not yet live. Plan requests are handled by email or WhatsApp until online subscription payments are enabled.

The subscription will continue or renew only in accordance with the terms expressly agreed to by the customer and permitted by applicable law.

Any recurring payment authorisation must clearly identify the relevant amount, frequency and applicable cancellation terms.

Customers are responsible for providing accurate billing and contact details.

If a payment fails, we may contact the customer to resolve the issue.

Any suspension or termination resulting from non-payment must comply with the applicable agreement, notice requirements and mandatory law.

6. Cancellation and Renewal

Customers may request cancellation using the methods made available in their subscription agreement or payment platform.

Cancellation requests may also be sent to info@topwebdefender.com.

The effective cancellation date, any notice period and any entitlement to a refund will depend on the accepted subscription conditions and applicable law.

Cancellation of a subscription does not automatically erase outstanding charges lawfully incurred before cancellation.

We will not impose undisclosed cancellation fees.

Any mandatory statutory cancellation rights remain unaffected.

7. Refunds and Statutory Rights

Refund eligibility depends on the nature of the purchased service, the applicable agreement, the status of work performed and mandatory law.

Nothing in these Terms excludes rights that cannot legally be waived.

Where services are sold to consumers, applicable consumer protection requirements, including relevant distance-selling and withdrawal provisions, must be observed.

Any request to begin providing services during an applicable statutory withdrawal period must be handled in accordance with legal requirements.

Refund decisions will not be based on blanket statements that all payments are non-refundable regardless of the circumstances.

8. Customer Responsibilities

Customers must provide accurate and reasonably complete information necessary to deliver the agreed services.

Where applicable, customers are responsible for:

  • Maintaining lawful ownership or authorisation over websites submitted for service
  • Providing authorised technical access where needed
  • Keeping domain registration and hosting arrangements active
  • Maintaining accurate administrative contact details
  • Informing us of relevant website changes
  • Maintaining suitable business continuity and backup arrangements unless backup services are expressly included in the purchased plan
  • Cooperating with reasonable security recommendations
  • Avoiding actions that knowingly compromise the security of managed systems

Customers must not provide access to systems they are not authorised to manage.

9. Website Access and Authorisation

To perform security-related work, Top Web Defender may require access to website administration, hosting control panels, files, databases or related infrastructure.

The customer confirms that they have the necessary authority to permit this access.

Access will be used only for the agreed service purposes.

Customers should provide appropriately restricted permissions where practical.

Where suitable, temporary credentials or delegated access should be used.

Credentials must be transmitted and handled using appropriate security measures.

On termination of services, access permissions should be reviewed and revoked where no longer necessary.

10. Malware Removal and Security Remediation

Malware cleanup and remediation can depend on the technical condition of a website, the nature of the compromise, available backups, third-party infrastructure and the customer's cooperation.

Some incidents may require additional work beyond the included subscription scope.

Where additional charges are necessary, the customer will be informed and asked to approve the relevant work.

Removal of identified malware does not guarantee that a website cannot be compromised again.

Certain incidents may require hosting-provider assistance, credential rotation, software replacement or further investigation.

11. Security Monitoring

Where security monitoring is included, the service is intended to help identify specified website security issues within the agreed monitoring scope.

Monitoring does not mean that every vulnerability, attack or malicious action will be detected.

Detection frequency, alerting methods, response procedures and remediation commitments depend on the relevant service plan or contract.

The existence of a monitoring subscription does not, by itself, constitute a guarantee of uninterrupted website availability or continuous human supervision.

12. Blacklist and Reputation Assistance

Top Web Defender may assist customers with identifying and addressing website issues that contribute to browser warnings, search engine security notifications or security-related reputation concerns.

We cannot guarantee that Google, browser vendors, antivirus companies, hosting providers or third-party blacklist operators will remove a warning within a particular period.

Final review and removal decisions are controlled by the relevant third-party organisations.

13. Third-Party Software and Infrastructure

Website security may depend on components outside our direct control, including:

  • Hosting providers
  • Domain registrars
  • Content management systems
  • Website plugins
  • Themes
  • Payment gateways
  • Third-party scripts
  • External APIs
  • Email services

Top Web Defender is not responsible for independently controlled third-party services except to the extent responsibility arises under an applicable agreement or mandatory law.

We may recommend updates, replacements or configuration changes where appropriate.

Additional costs associated with third-party software or infrastructure must be disclosed where they are not included in the agreed service.

14. Customer Data and Confidentiality

In providing security services, we may encounter confidential business information, website files, technical records or personal data.

We will use such information only for authorised purposes and in accordance with applicable confidentiality, security and data protection obligations.

Customers must inform us of relevant security, confidentiality or regulatory requirements before granting access where these affect the agreed services.

Where processing personal data on behalf of a customer requires a data processing agreement, the parties will establish the necessary agreement.

15. Backups and Data Recovery

Customers should maintain appropriate backups of important website files and databases.

Unless specifically included in the purchased service, website backup management, disaster recovery and restoration services are not automatically provided.

Where backup or recovery work is included, the relevant agreement should specify frequency, retention, responsibilities and restoration limitations.

No backup system guarantees that all data can be recovered in every circumstance.

16. Service Availability and Maintenance

We aim to provide services professionally and with reasonable care and skill.

Scheduled maintenance, emergency security work, infrastructure faults, internet disruptions or third-party outages may affect service delivery.

Specific uptime percentages, guaranteed response periods or financial service credits apply only where expressly included in an applicable service-level agreement.

17. No Absolute Security Guarantee

Website security involves changing technologies, vulnerabilities and threat activity.

No security provider can guarantee the prevention or detection of every possible attack.

Top Web Defender provides services within the agreed technical scope and with the level of care required by applicable law and contract.

Security outcomes depend on several factors, including website architecture, hosting, third-party software, customer practices and newly discovered vulnerabilities.

18. Intellectual Property

Unless otherwise stated, website text, graphics, branding and other original materials published by Top Web Defender are protected by applicable intellectual property laws.

Visitors may access and use the website for lawful informational and business purposes.

Unauthorised reproduction, commercial exploitation or redistribution of protected materials is prohibited except where permitted by law or with the relevant rights holder's permission.

Customers retain ownership of their own websites, content and business data, subject to applicable agreements and third-party rights.

19. Acceptable Use

Users and customers must not use our website or services for unlawful purposes.

Prohibited activity includes:

  • Attempting unauthorised access
  • Interfering with website functionality
  • Distributing malicious software
  • Submitting fraudulent information
  • Abusing communication channels
  • Requesting security testing of systems without proper authorisation
  • Using the services to facilitate unlawful activity

We may take appropriate and lawful action to address misuse.

20. Limitation of Liability

Top Web Defender will perform its contractual obligations in accordance with applicable law.

Liability for losses arising from service delivery will be determined by the applicable agreement, the nature of the loss, the parties' responsibilities and mandatory legal requirements.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Any proposed contractual liability caps, exclusions of indirect losses or specific indemnity arrangements must be separately reviewed and expressly agreed where appropriate.

21. Suspension or Termination

Services may be suspended or terminated in circumstances permitted by the relevant agreement and applicable law.

Potential grounds include material contractual breaches, unlawful use, security risks or unresolved payment failures.

Where required, appropriate notice and an opportunity to remedy the issue will be provided.

Following termination, the parties remain responsible for obligations that lawfully survive the termination of the agreement.

22. Changes to Services and Terms

We may update service information or these Terms when reasonably necessary.

Material contractual changes affecting existing customers will be handled according to the applicable agreement and legal requirements.

An updated version of these Terms will be published on the website with a revised date.

Publication alone does not automatically override an existing customer agreement or remove mandatory customer rights.

23. Governing Law and Disputes

These Terms are governed by the applicable laws of the Republic of Cyprus, subject to any mandatory consumer protections or other laws that cannot lawfully be excluded.

The parties should initially attempt to resolve disputes through direct communication.

Where disputes cannot be resolved, the competent courts or other legally available dispute resolution mechanisms will be determined in accordance with applicable law.

Nothing in this section removes a consumer's mandatory right to bring proceedings in a jurisdiction or forum protected by applicable legislation.

24. Consumer and Business Customers

Certain rights and obligations may differ depending on whether a customer purchases services in a personal capacity or on behalf of a business.

Where customers qualify as consumers under applicable law, mandatory consumer protections continue to apply.

Business customers may also be subject to additional negotiated contractual provisions.
